AI or Not — Terms of Service

These Terms of Service ("Terms") govern your use of the AI or Not mobile application (the "App") provided by BitAutor UG (haftungsbeschränkt) ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Language note: This English version is the authoritative and legally binding version. Any German summary or translation is provided for convenience and transparency only. Mandatory consumer rights under German and EU law remain unaffected.

2. Description of the App

AI or Not is a casual game in which players guess whether presented content is AI-generated or human-created. The App may include scores, experience points (XP), levels, streaks, leaderboards, and optional social sign-in to save progress across devices.

The App is provided for entertainment and educational purposes. It does not constitute professional advice on AI detection, content authenticity, or any other subject.

Before the first game round starts, the App asks you to accept these Terms. If you do not accept them, you must not start gameplay.

3. Eligibility

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority in your country, you may use the App only with the consent of a parent or legal guardian.

You represent that you have the legal capacity to enter into these Terms and that your use of the App complies with all applicable laws.

4. Accounts

Anonymous play: You may use the App without creating a traditional account. An anonymous session is created automatically so you can play and save progress on your device.

Optional sign-in: You may optionally link your progress to Google or Apple sign-in. You are responsible for maintaining the security of your third-party account credentials.

You are responsible for all activity under your App account. Notify us immediately at admin@best-ai-tools.org if you suspect unauthorised access.

5. Gameplay, Scores & Leaderboards

• Scores, XP, and rankings are calculated by our systems and are not guaranteed to be error-free.
• We may adjust, reset, or remove scores that result from cheating, exploits, bugs, or technical errors.
• Leaderboard positions are provided "as is" and may change as other players participate.
• We may modify game mechanics, difficulty, content, or features at any time without prior notice.

6. Fair Play & Prohibited Conduct

You agree not to:

• Cheat, use bots, scripts, automation, or unauthorised third-party tools
• Exploit bugs or vulnerabilities (report them to admin@best-ai-tools.org instead)
• Manipulate leaderboards or impersonate other players
• Reverse engineer, decompile, or attempt to extract source code except as permitted by law
• Use the App for any unlawful, harmful, or abusive purpose
• Interfere with or disrupt the App, servers, or other users' experience

We may suspend or terminate your access where reasonably necessary to protect the App, other users, or our legal rights, including for material or repeated violations of these Terms.

7. No Real-Money Gambling

AI or Not is a free-to-play casual game. It does not offer real-money gambling, betting, prizes with monetary value, or lottery services. Any in-app purchases (if introduced in the future) will be clearly disclosed and subject to the respective app store's payment terms.

8. Intellectual Property

The App, including its design, graphics, text, software, trademarks, and game content, is owned by or licensed to BitAutor UG (haftungsbeschränkt) and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the App without our prior written consent.

9. User-Generated Content

If the App allows you to set a display name or similar profile information, you must not use offensive, misleading, or infringing content. We may remove or modify such content at our discretion.

10. Privacy

Our collection and use of personal data is described in our AI or Not Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that AI/human classifications in the game are accurate in real-world contexts. Game results are for entertainment only.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITAUTOR UG (HAFTUNGSBESCHRÄNKT) AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

For users in Germany and the European Union, we are liable without limitation for intent, gross negligence, injury to life, body, or health, guarantees expressly given by us, and claims under mandatory product liability law. For ordinary negligence, we are liable only for breach of essential contractual obligations and only for typical, foreseeable damage. In all other cases, liability is excluded to the extent permitted by law.

Nothing in these Terms limits any mandatory consumer rights or any liability that cannot be excluded under applicable law.

13. Termination

You may stop using the App at any time. Delete your account via the account deletion page or as described in our Privacy Policy.

We may suspend or terminate your access to the App with notice where reasonably possible if you materially violate these Terms, misuse the App, create security or legal risk, or if we discontinue the App. Immediate action may be taken where required to prevent harm, fraud, abuse, or legal exposure.

14. App Store Terms

Apple: If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and BitAutor UG (haftungsbeschränkt), not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for App warranties, product claims, or intellectual-property claims, except where Apple's own terms or mandatory law say otherwise. Apple is a third-party beneficiary of these Terms and may enforce them against you. You must comply with the Apple Media Services Terms and App Store Review Guidelines.

Google: If you downloaded the App from Google Play, you acknowledge that Google is not responsible for the App or its content. You must comply with Google Play's terms of service.

15. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. If you are a consumer residing in the EU, you retain mandatory protections of the laws of your country of residence.

The courts of Hannover, Germany shall have exclusive jurisdiction for disputes arising from these Terms, unless mandatory consumer law provides otherwise. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228.

16. Changes to These Terms

We may update these Terms prospectively. Material changes will be communicated by updating the "Last Updated" date and, where appropriate, via in-app notice at least 30 days before they take effect. If you do not agree to updated Terms, you must stop using the App and may delete your account. Where applicable law requires explicit consent to a change, the change will not apply to you until consent is given.

17. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BitAutor UG (haftungsbeschränkt) regarding the App.
